Definition of a lease management
The management lease is a lease of a business by which the owner of the funds entrusted operation of it to a manager, the latter operating the funds on its behalf and in its peril. In exchange, the Manager pays the owner a rent or a fee, the amount is freely determined by the parties. The manager and the fund operates while the lessor retains ownership.
The operator of the fund must have operated for at least two consecutive years. This length is not required when the heirs or legatees of a goodwill wish to give the lease management, including when it comes to the surviving spouse. (Court of Cassation, judgment of 11 December 2007; 05-19145)
